A (des)proteção das vítimas de violência doméstica e dos seus direitos fundamentais

Abstract

A violência doméstica é um problema social, duradouro e resistente, e como tal, atual e de difícil resolução. Ainda que, cada vez mais visível e desocultado, dada a dimensão e complexidade do fenómeno, é um assunto que continua a merecer tratamento. Embora tenha ocorrido uma enorme evolução no âmbito desta problemática e se é certo que o nosso ordenamento jurídico já dispõe de inúmeros instrumentos para o combate desta realidade, é necessário repensar como podemos aplicar os referidos instrumentos, sobretudo, no que respeita à proteção das suas vítimas. O presente trabalho de investigação intitula-se “A (des)proteção das vítimas de violência doméstica e dos seus direitos fundamentais”, pelo que procuraremos compreender o fenómeno da violência doméstica na sua generalidade e em particular, o regime de proteção das vítimas de violência doméstica existente em Portugal, e se este regime consubstancia em termos práticos uma proteção efetiva e real da vítima, ou se pelo contrário, traduz-se numa desproteção das vítimas. Em muitos casos de violência doméstica, as vítimas são encaminhadas para casas de abrigo, vendo-se obrigadas a abandonar, não apenas os seus lares, mas também as suas famílias, empregos e círculo social, revelando-se assim a proteção à vítima, muitas vezes, contraditória, conduzindo-nos inclusive à problemática da vitimização secundária. Por outro lado, os agressores enfrentam poucas restrições aos seus direitos fundamentais. O encaminhamento prévio das vítimas para casas de abrigo dificulta a aplicação efetiva das medidas de coação disponíveis no nosso ordenamento jurídico.

Domestic violence is a social problem, enduring and resistant, and as such, current and difficult to solve. Although it is increasingly visible and unhidden, given the dimension and complexity of the phenomenon, it is a subject that still deserves to be addressed. Although there has been an enormous evolution in the scope of this problem and even if it is true that our legal system already has numerous instruments to combat this reality, it is necessary to rethink how we can apply those instruments, especially in what concerns the protection of its victims. This research work is entitled "The (un)protection of victims of domestic violence and their fundamental rights", so we will try understand the phenomenon of domestic violence in general, and then, we will analyze the victim protection regime existing in Portugal, and if this regime embodies in practical terms an effective and real protection of the victim, or if, on the contrary, it translates into a lack of protection of the victims. In many cases of domestic violence, victims are sent to shelters and are forced to leave not only their homes, but also their families, jobs, and social circles, which means that victim protection is often contradictory, leading us to the problem of secondary victimization. On the other hand, aggressors face few restrictions on their fundamental rights. The prior referral of victims to shelters makes it difficult the effective application of the coercive measures available in our legal system.
