Título: A tutela antecipatória da responsabilidade civil : da responsabilidade pelo dano ambiental futuro e incerto

Resumo: A presente tese visa, por um lado defender, por outro provar, que a violação intolerável do princípio da precaução fará impender sobre o lesante a obrigação de indemnizar os lesados. Nestes termos defendemos, claramente, que a violação daquele princípio material de ambiente, dará, naturalmente, origem a acções de responsabilidade civil. Tendo em conta o (acima mencionado) escopo da presente tese, defender-se-á que a violação do princípio em causa, implica, no presente, a criação de um risco ambiental, risco esse que, de futuro, constituirá um dano ecológico. E constituirá um dano ecológico futuro porque, desde logo, face ao risco presente a comunidade científica não exclui liminarmente a hipótese, futura, da sua concretização e da correspondente verificação, também futura, do dano. Assim sendo, se não o exclui, admite-o e, se o admite, mesmo que probabilisticamente, prevê que o mesmo se possa vir a concretizar. Neste viés, defendemos que nos encontramos na presença de um dano futuro, sendo este definido e indemnizável nos termos previstos no Código Civil. Por outro lado, também defendemos que a violação do princípio da precaução causa, quanto a nós sem margem para dúvidas, situações geradoras de angústia e medo na comunidade. Nesta senda, defendemos que o medo de um grave dano ambiental futuro é um dos grandes medos sociais dos nossos dias e, por assim ser, a violação daquele princípio material de ambiente gera um dano moral colectivo. Este, como dano (não patrimonial) que é, deverá impor ao lesante a correspondente obrigação de indemnizar a colectividade que o sofre. Para tanto foi necessário analisar e descrever, de forma exaustiva e geral, o vetusto instituto da responsabilidade civil tal como este se encontra previsto no Código Civil, bem como as principais leis que, entre nós, o prescrevem como “mecanismo jurídico” adequado a fazer face a danos ambientais e ecológicos.
This thesis aims to defend on the one side, and proving on the other side, that the unbearable violation of the precautionary principle shall bring over the agent the burden to compensate those that were damaged with such breach. Under such terms, we clearly defend that the violation of such material principle of the environment, will naturally give cause to civil liability lawsuits. Taking in consideration the above mentioned scope of this thesis, it will be defended that the breach of the said principle, implies in the present day the creation of an environmental risk, which will in the future constitute an ecological damage. And it will constitute an ecological damage in the future, to start with, because in face of the present risk, the scientific community does not exclude upfront the possibility of its future concretization and of the correspondent verification of the damage, also in the future. Thus being, by not excluding it, its existence is admited, and if so, it predicts at least probabilistically that the same may occur. Following this path, we take the view that this is a future damage, defined and indemnifiable under the Civil Code. Furthermore, we also take the view that the violation of the precautionary principle causes, beyond any doubt, situations that raise anguish and alarm within the community. Hence, we defend that the fear of a serious environmental damage in the future is one of the main social worries of nowadays, and for that reason, the violation of that material principle of the environment generates a collective moral damage. This moral damage as such, must impose to the agent the respective burden to indemnify the collectivity that suffers the said damage. For that reason, it was necessary to analyse and describe, both exhaustively and in general, the old civil liability regime as established in the Civil Code, as well as the main laws that among us resort to the said civil liability regime as the adequate legal mechanism to face environmental and ecological damages.
