Debate sobre o anonimato do dador na PMA

Abstract

A Lei da Procriação Medicamente Assistida (Lei 32/2006, de 26 de julho), que regula a utilização de técnicas de PMA, foi aprovada em 2006, com o objetivo de cumprir a imposição do art.67º, nº2, al. e) da CRP, determinando que incumbe ao Estado para a proteção da família regulamentar a procriação assistida, em termos que salvaguardem a dignidade da pessoa humana. Contudo, a alteração à LPMA, introduzida pela lei 48/2019, de 8 de julho, modificou o regime da confidencialidade, previsto no art.15º. No novo quadro normativo, o anonimato dos dadores de gâmetas ou embriões desapareceu. Desta forma, o objetivo deste estudo consiste em perceber e analisar o impacto e os riscos desta nova alteração à LPMA.

Abstract The Medically Assisted Procreation Law (Law 32/2006 of July 26th), which regulates the use of PMA techniques, was approved in 2006 in order to fulfil the imposition of art. 67, no. 2, subparagraph e) of the Portuguese Constitution which determines that the State protects the family and regulates assisted procreation with regards to safeguarding the dignity of the human person. However, the amendment to the LPMA introduced by Law 48/2019 of July 8th, modified the confidentiality regime provided by article 15. In the new regulatory framework, the anonymity of gamete or embryo donors has disappeared. Therefore, the objective of this study is to find and analyse the impact and risks of this new change in the LPMA.
