A «politização da justiça» : a escolha política dos magistrados

Abstract

Numa época em que se manifesta uma clara inquietação da opinião pública face ao fenómeno da corrupção aumenta a atenção para a actividade dos juízes, principalmente quando estes têm de decidir sobre processos que envolvem dirigentes e actores da vida política. Mas do mesmo modo que essa atenção aumenta, surge em inúmeras situações a dúvida quanto à real independência dos juízes, atendendo à intervenção do poder político na escolha de muitas magistraturas. Este artigo pretende, pois, analisar em que medida o poder político intervém na escolha dos magistrados, à luz da Constituição portuguesa.

At a time when there is a clear concern of public opinion about the phenomenon of corruption, the attention to the activity of judges is expressed, especially when they have to decide on processes involving leaders and actors of political life. But just as this attention increases, in many situations comes the doubt as to the real independence of judges, given the intervention of political power in the choice of many judiciaries. This article therefore intends to examine to what extent political power intervenes in the choice of magistrates, in the light of the Portuguese Constitution.
