O neoliberalismo de regulação como intervenção do Estado : a regulação e a Constituição Brasileira de 1988

Abstract

O presente trabalho destina-se a versar sobre o neoliberalismo de regulação como uma técnica de intervenção do Estado no domínio económico e social no sistema capitalista do seculo XXI e uma imposição do poder económico privado as nações e aos povos. Sendo a não acção um mito mediático e uma ret6rica académica. A partir do estudo dos comandos da Constituição Brasileira actual, alterados para atender a regulação, mostraremos como aquela impõe ao Estado o poder I dever de agir na vida socioeconómica, existindo ainda incompatibilidade pratica entre a actuação regulatória estatal e a efectivação ao dos ditames transformadores da Carta Magna de 1988.

This paper deals with new liberalism of regulation as a technique of state intervention in the economic and social domain in the capitalist system from the 21st century and an imposition of economic power private for nations and people. Since no action is a myth of the press in general and an academic rhetoric. From the study of the commands of the current Brazilian Constitution, modified to meet the regulation, we show how constitution rules the Government, requires the power/ duty to act in socioeconomic life and there is still conflict between practice performance and effectiveness of the state regulatory dictates processors of the 1998 Constitution of Brazil.
