Unidade e diversidade na construção europeia

Abstract

A presente dissertação versa sobre a questão da unidade e diversidade na construção europeia, ou seja, pretende rever a questão da tensão inelutável no processo de integração, entre o ímpeto de unificação e a determinação em preservar a especificidade das partes componentes. Para o efeito, começa por tentar caracterizar o processo genérico da formação de comunidades, verificando que esse processo de ordenação social foi marcado pela afirmação central de um critério de natureza hierárquica: o princípio da soberania. Deste princípio - que, por força da sua natureza, marcou profundamente a forma como se perspectivou a referida tensão entre a vontade de unidade e a de preservação das partes componentes -, são depois sublinhadas algumas fragilidades e contradições. Referem-se, a seguir, as tentativas de superação da ordenação hierárquica no âmbito do processo de construção europeia, na jurisprudência e na doutrina, as quais não conseguiram esclarecer os contornos e as variáveis do processo, afastando-o do debate político que devia legitimá-lo. Por isso, nos esforçamos, na terceira parte, por apresentar uma matriz de análise que permita uma visão de conjunto dos diferentes contributos doutrinais em matéria de integração - e especificamente no tocante à forma como se perspectiva a tensão entre unidade e diversidade. Nessa matriz distinguimos dois grupos: um primeiro que se caracteriza por desvalorizar essa tensão, e um segundo em que se integram os contributos que procuram regular a referida tensão. Concluiremos sublinhando a importância da regulação da tensão e da necessidade de perspectivar a integração europeia segundo esses modelos.

This work focuses on the issue of unity and diversity in the European integration process, with the purpose of reviewing the tension between the impetus of integration and the determination of each of its cornponents to preserve its specificity. To this effect, it begins (Part 1) by atternpting to characterize the general process of the formation of cornrnunities, proving that this process of social organization was marked by a central affirmation of a hierarchical nature: the principle of sovereignty a central criterion of power sharing that deeply marked the tension between unity and diversity. Its fragility and inner contradictions are then analyzed, leading us to the attempts made on the European integration process by main authors and case law, to overcome the hierarchical systern (Part 2). At that point, we shall notice that these were unable to make the process and its variables clear enough to allow the necessary political debate on its legitimacy. That is why in part 3 we try to draw an analytic rnatrix through which one can methodically analyze all the main integration theories, based on the unity-diversity tension. There we shall identify two rnajn groups: a first group where the tension is devalued and a second one in which the attempts to regulate that tension are collected. We shall conclude by pointing out the importance of regulating the tension and the advantages of analyzing the process of European integration through these models.
