Abstract

A relação entre as eleições legislativas e a formação do governo em Portugal é um tema intrigante que envolve tanto aspetos jurídicos quanto práticos. De acordo com a constituição portuguesa, as eleições legislativas têm o propósito de eleger a Assembleia da República, órgão legislativo do país. No entanto, na prática e na perceção pública, as eleições também são um meio indireto de eleger o primeiro-ministro. O texto pretende analisar essa dinâmica, articulando os paradigmas “de jure” e “de facto”.

The rapport between legislative elections and the formation of the government in Portugal is an intriguing topic that involves both legal and practical aspects. According to the Portuguese constitution, legislative elections are intended to elect the Parliament, the country’s legislative organ. However, in practice and public perception, elections also serve as an indirect means of electing the Prime Minister. This essay analyzes this dynamic by articulating the “de jure” and “de facto” paradigms.
