Título: A dimensão fragmentária da jurisdição do Tribunal Penal Internacional : consequências ao nível da justiça portuguesa

Resumo: A criação do Tribunal Penal Internacional, após a experiência dos Tribunais Ad Hoc, reflecte a preocupação da comunidade internacional relativamente aos crimes contra a humanidade, crimes de guerra, genocídio e de agressão, bem como a ambição de desenvolvimento de um mecanismo permanente capaz de prevenir e reprimir essa mesma criminalidade. Para o efeito, pondera-se a garantia do direito à justiça e o fim da habitual impunidade, ressalvando-se a soberania dos Estados e a primazia da sua jurisdição, que à luz do princípio da complementaridade, previsto no Estatuto de Roma do Tribunal Penal Internacional, prevalece nas relações entre a jurisdição do Tribunal e dos Estados Partes. No contexto da implementação do Estatuto de Roma, é essencial que os Estados Partes reconheçam os crimes da competência do Tribunal Penal Internacional como sendo crimes internacionais, transpondo-os para as ordens jurídicas internas e simultaneamente preparem o seu ordenamento jurídico para o exercício da primazia da sua jurisdição ou para uma eventual actuação do Tribunal o que, a verificar-se, passará obrigatoriamente pelo cumprimento do dever de cooperação a que os Estados se obrigam pelo Tratado. Neste âmbito, em Portugal, constatou-se a incompatibilidade de algumas disposições entre o Tratado de Roma e a Constituição da República Portuguesa, como. por exemplo, a questão das imunidades e da prisão perpétua, que obrigaram a uma revisão extraordinária da Constituição, para que o acto de ratificação do Tratado de Roma não fosse considerado inconstitucional. Verificou-se, também a necessidade de proceder a alterações legislativas no sentido de que os crimes da competência do Tribunal tivessem previsão no nosso ordenamento jurídico, ficando Portugal deste modo preparado para o exercício da sua jurisdição de acordo com o princípio da complementaridade previsto no referido Estatuto.
After the experience of the ad hoc Tribunals the creation of the Intemational Criminal Court happens as a result ofthe international community’s concern for crimes against humanity, genocide, aggression and war crimes. One of its ambitions is that of developing a permanent mechanism able to prevent and prosecute this type of criminality. For this purpose the guarantee of the right to justice and the end of the usual impunity comes into consideration, emphasizing the State sovereignty and primacy of its jurisdiction, which in light of the principle of complementarity, established in the Rome Statute of the Intemational Criminal Court, prevails in the relationship between the Court and Member States. Within the context of implementation of the Rome Statute it is essential that Member States recognize the crimes under the competency of the Intemational Criminal Court as international crimes, transposing them to their juridical system while simultaneously preparing their legal system for the exercise of primacy of their jurisdiction or a possible intervention by the Court, action which would ensure the fulfillment of the obligation of cooperation to which the States are bound to by the Treaty. In this area it was noted in Portugal the incompatibility of some provisions of the Rome Treaty, regarding the Constitution of the Portuguese Republic, like the question of immunities and life imprisonment, which caused an extraordinary revision of the Constitution in order to be able to proceed with its ratification. There was also a need for legislative changes so that crimes within the jurisdiction of the Court would be equaily predicted in our legal system, leaving Portugal like this prepared for the exercise of its jurisdiction in accordance with the principle of complementarity established under the above mentioned Statute.
