Título: Os paraísos fiscais

Resumo: A presente dissertação tem como objetivo primordial analisar a problemática dos paraísos fiscais. Não se pretende aqui um estudo exaustivo, mas sim abordar esta temática sob o ponto de vista fiscal. A dissertação encontra-se estruturada por capítulos, iniciando-se com uma pequena abordagem histórica, de modo a que seja possível entender quando surgiu este fenómeno; de seguida, tratamos de enunciar as principais características exigidas a um território para que este possa ser considerado um paraíso fiscal. No terceiro capítulo achamos de grande relevo fazer alusão às infrações fiscais visto que é através destes comportamentos que estes territórios são utilizados. Seguidamente são mencionados os fatores que na maioria das vezes os contribuintes têm em conta na hora de optar por um paraíso fiscal. No capítulo quinto é feita referência às técnicas de utilização dos paraísos fiscais, ou seja, mecanismos que estão dentro dos limites legais estabelecidos que os utilizadores aplicam para fugir à tributação existente no seu país de origem. O capítulo que se segue enaltece o facto de estes territórios serem frequentemente procurados quando em vista estão objetivos de cariz extrafiscal e criminal, fazendo uma breve alusão a algumas dessas práticas. No sétimo capítulo é feita uma menção à OCDE e aos trabalhos que esta organização tem levado a cabo para tentar combater estas práticas prejudiciais para as economias. O capítulo seguinte centra-se em Portugal, mais precisamente no regime especial existente na denominada Zona Franca da Madeira que, apesar de não se incluir na categoria de um paraíso fiscal, trata-se de uma região onde existe um regime fiscal mais favorável, sobre a forma de Auxílio de Estado, aprovado e apoiado pela União Europeia. Finalmente, no último capítulo da presente dissertação é feita uma referência de carácter não pormenorizado a alguns paraísos fiscais existentes a nível mundial, de forma a podermos observar como são constituídos, quais as suas características e a formas como estes funcionam.
Abstract: The following dissertation aims to analyze tax heavens. We do not intent here an exhaustive study but to manage this issue under the taxation point of view. The work is structured by chapters, beginning with a quick historical approach so we can be able to understand how and when this phenomenon arose; then we try to outline the main characteristics required on a territory so it can be considered a tax heaven. In the third chapter, we have found the reasons why it is important to allude tax offenses because people use tax heavens as a way of escaping to commit tax crimes. Then we will mention the motivations that taxpayers have in mind when they need to choose a tax-free country. On the fifth chapter we mention the techniques used in tax heavens and make a reference to the mechanisms that are used within the required legal limits that users apply to avoid the existing taxes in their original country. The following chapter welcomes the fact that these areas are frequently used by people so they can be able to run from the criminal law and perform their illegal objectives, making a brief reference to some of these practices. In the seventh chapter, we make a mention to OECD and to the work that this organization has been doing to try to fight these harmful practices to the economics. The next chapter focuses on Portugal, more precisely on the existence of a free tax zone in Madeira. Although this little island is not included in the tax heaven category, it’s a territory where we have taxes that are more favorable as a state aid form, approved and supported by the European Union. Finally, on the last chapter of this dissertation we made a non-detailed reference to some existing tax heavens around the world so we can know how they work, what are their characteristics and how they were implemented.
